Terms of use

PopApp is operated from Bangkok, Thailand. Where these terms say "we" or "us", that means PopApp; "you" means anyone using the site, whether as a visitor, a shop or an organizer.

We publish information about markets: dates, opening hours, venues and who runs them. Some of that comes from organizers directly, and some we compile from public sources.

We check listings by hand and re-check them regularly, but we do not run the markets and cannot guarantee that a market opens, keeps the hours listed, or exists at all by the time you travel. Markets get rained off, move venue and cancel at short notice. Treat a listing as a strong pointer, not a promise, and check with the organizer before making a long trip.

We are not a party to any arrangement between a shop and an organizer. Booth fees, stall allocation, cancellations and refunds are between the two of you.

Listings, shop pages and open calls are public pages. Search engines index them, they can be shared as links, and they show a preview image and summary when they are. The shop directory itself is closed for now, but an individual shop page is reachable by anyone who has its link. That is how vendors get introduced to organizers.

We count how often a listing is viewed, saved, shared and added to a calendar, and show those totals to the organizer who runs it. They are counts of actions, not of people; see the privacy policy for what that does and does not involve.

You can browse without an account. Shops and organizers need one, and you agree to give accurate information, keep your password to yourself, and take responsibility for what happens under your account.

Organizer accounts are verified by us before they can publish. We may decline or withdraw verification if we cannot establish that an account genuinely runs the markets it claims to.

Some listings, shop pages and organizer profiles are created by us before the business joins, from information that is already public. If one of them is yours, you can claim it rather than build a second one: claiming attaches the existing page to your account, keeps the history and the applications already attached to it, and replaces our summary with what you write. If you would rather it came down instead, ask us and it comes down.

One shop page per account. You can close your account at any time.

You keep ownership of the text and photos you upload. By uploading them you give us permission to display, resize and distribute them on the site and in things like our newsletter and social posts, for as long as your listing or shop page is up.

Do not upload anything you do not have the right to use. Do not post:

• content that misrepresents who you are or what you sell
• someone else's photos, branding or menus without permission
• counterfeit goods, or anything illegal to sell in Thailand
• abuse, harassment or spam, including in messages to organizers
• photographs in which people are identifiable, unless they agreed to the photo being published

That last one matters more than it used to. Organizers can add photos of a market: the stalls, the venue, the crowd. A crowd shot is a photograph of people who did not upload it and cannot take it down. Anyone who appears in one can ask us to remove it, and we will, without asking them to justify it.

Listings can carry both an English and a Thai version of the same description. Whoever writes them is responsible for both; we do not translate one into the other, so an out-of-date Thai version stays out of date until someone fixes it.

We can remove content and suspend accounts that break these rules. For serious or repeated cases we will do so without notice.

An organizer can open a call for vendors on a market, and shops can apply to it through the site. The deadline, the booth prices, the number of stalls and whatever the note asks for are the organizer's own terms, not ours. Applying is not a booking, and nothing obliges an organizer to reply, to accept, or to explain a decision.

A call can be opened before the market itself is listed, for organizers whose first job is filling the stalls. When it is, the call has its own public page and appears on our open calls list even though the market is not on Discover yet, so treat what you write in a call as published the moment you open it, whatever state the listing is in.

Organizers: a market you have opened a call on is one shops are spending time applying to. Close the call when you have filled it.

When a shop applies to a market, the two sides can message each other on the application. Those messages are visible to both parties and to us. Keep them about the market. Do not use them to send unsolicited promotions.

Using PopApp is currently free for shoppers, shops and organizers. If we introduce charges we will say so clearly before they apply to you, and never for something you have already done.

Listings link out to Instagram, Facebook, LINE, ticket sellers and map providers. Those services have their own terms, and we are not responsible for what happens on them.

The site is provided as it is. To the extent the law allows, we are not liable for wasted journeys, lost sales, cancelled markets, or any indirect loss arising from using the site or from dealings between shops and organizers.

Nothing here limits liability that cannot be limited under Thai law.

We may update these terms as the product changes. The date at the top shows when they last changed, and continuing to use the site after a change means you accept the new version.

These terms are governed by the laws of Thailand, and the courts of Thailand have jurisdiction over any dispute.
